In the month of October, the Enforcement Division of the Ministry of Domestic Trade, Cooperatives and Consumerism (MDTCC), assisted by CyberSecurity Malaysia and MACP, successfully conducted two raids on premises located in Klang Valley.
On 3 October 2013, the first raid and seizure was carried out on an outlet located at Kompleks Metro Pudu, Fraser Business Park in Kuala Lumpur; followed by the second raid on 25 October 2013, on a Family KTV Karaoke in Kota Damansara.
Despite several warnings and legal notices, both outlets had refused to obtain a MACP licence for the publicly performing musical works at their premises which constitutes an offence under S41(3) of the Copyright Act, 1987.
Among the musical works identified to be publicly performed without MACP’s permission, included popular songs composed by its members Dato M Nasir, Habsah Hassan, Kenny Tay, Sani Sudin, S Amin Shahab, Juwie, A Ali, Ramli Sarip and many others.
MDTCC seized TV monitors, karaoke systems and servers, CPU, microphones, speakers and modems from the outlets. If convicted under the Copyright Act 1987, the owners of the premises face fines ranging from RM10,000 – RM50,000 or to imprisonment for a term not exceeding 5 years, or both.
