01. General Policy
MACP is committed to protecting your personal information in accordance with Malaysian privacy laws.
The purpose of this Personal Information Notice (“Notice”) is to bring to your attention MACP’s practices and policies relating to the collection, use, protection, processing and disclosure of personal information.
The personal information that MACP processes is sourced from information provided by you, third party information sources, or information otherwise generated upon your access to MACP’s website or related applications and in the course of your dealings with MACP. By visiting our website or use of any related applications, interacting with us, or providing your personal data to us including arising from the provision of services by us, you are deemed to have read and consent to the data practice and policy described in this Notice as may be varied from time to time.
02. Source of Information
Specifically, you may be asked to provide information relevant to your dealings, membership with and/or matters connected to MACP, including but not limited to, your name, address, telephone numbers, e-mail address, NRIC, your company or enterprise information, bank account information and all other information that will be required or applicable in relation to any such dealings, membership and/or connection with MACP.
03. Usage of Your Personal Data
3.1 MACP collects, processes and retains this personal information for its legitimate functions and in furtherance of its objectives including but not limited to:
- Dealing with your enquiries and requests;
- Administering member and licensee records;
- Maintaining information as a reference tool or general resource;
- Contacting you by email, a messenger application and/or post for the purpose of providing you information (including where requested by you when you visit us on our website or any related applications), updates, marketing information and information concerning our role, functions and/or objectives, licences and membership related matters;
- Responding to any matter which requires us to use your information for the purpose of providing transparency and/or clarity, or for the purpose of defending allegations against us or rectifying any misrepresentation or inaccuracy;
- Presenting your information for the purpose of reporting where it is required in the furtherance of our functions and/or objectives;
- Sharing your information with our approved third party suppliers or vendors;
- For such other purposes as may be required by law; and
- For any purpose incidental, ancillary or in furtherance to the above mentioned purposes.
3.2 MACP may also disclose this personal information to:
- Our related entities;
- Overseas collecting societies that administers the performing right in musical works and that have reciprocal agreement with MACP;
- Expert advisers to MACP who have been engaged to provide MACP with legal, administrative, financial, research or other services;
- Any person to whom we are compelled or required to do so under law or in response to a competent regulatory or government agency;
- Government bodies, law enforcement agencies, industry regulators, statutory authorities;
- MACP’s approved suppliers or vendors;
- Any other party that we deem necessary for the purposes as outlined in item 3.1.
3.3 MACP may conduct credit/trade checks with any credit reporting agency/ies pursuant to the Credit Reporting Agencies Act 2010 on you if we have a trade relationship with you or where any dues remain unpaid and outstanding by you, wherein:
- Sole proprietors, partners, company director(s) and/or shareholder(s) (collectively the “Parties”) may be subject to the opening of account(s), credit/account review, debt recovery, credit/account monitoring and credit/account evaluation;
- MACP may disclose any information on the Parties’ conduct of their accounts with MACP, to any business entity/ies for bona fide trade checking at any time. The Parties are also aware and understand that such information will be provided to a credit reporting agency/ies, who may in turn share such information to subscribers of their service;
- Where MACP require any processing of your information by any processing centre located outside Malaysia, the Parties hereby give consent to the credit reporting agency/ies to disclose their credit reports to such locations outside Malaysia.
3.4 If you do not agree or consent to us using your personal information for the purposes set out in items 3.1, 3.2 and 3.3 above, please notify us via the contact details set out in item 8 below.
3.5 It is voluntary for you to provide your personal information to us. However, if you do not wish to provide your personal information or decide to revoke your consent in relation thereto, then we may not be able to carry out or face difficulty in carrying out the purposes set out in item 3.1 above, including without limitation responding to your queries, processing your application, renewing your membership, making any payment (where due) or such other matters connected to the functions or objectives of MACP in its relationship with you, whereby we will not be liable or accountable for any failure or delay on our part to carry out our functions pursuant to your withholding or revocation of consent.
04. Disclosure to Third Parties
Save and except mentioned in item 3.3 above, where MACP discloses your personal information to third parties, MACP will ensure that those parties are bound to abide by MACP’s, or equivalent, personal information practices and policies relating to the collection, processing, disclosure and retention of your personal information.
05. Other Websites
Our website may contain links to other websites which are not within MACP’s control and are not bound by MACP’s Privacy Policy. If you access other sites using the links provided, the operators of these sites may collect information from you which will be used by them in accordance with their privacy policy, which may differ from ours. MACP shall not be responsible for any personal information that you may provide to other entities via these links. For the avoidance of doubt, any reference to ‘our website’ shall also include any related applications.
06. Our Legal Obligations
MACP uses the personal information that it collects to fulfil its legal obligations and to keep its licensees informed of MACP’s activities and services that it provides to its licensees, and for purposes set out in item 3 above. However, if you:
- Wish to limit the processing of certain aspects of your and/or another person’s personal information;
- Wish to exercise your right to seek access to and/or to correct your personal information retained by MACP; or
- Have any questions or issues regarding your personal information or have any complaints regarding the unauthorised use, disclosure or transmission of your personal information;
Please feel free to write into us at the contact details listed in item 8 below or to our General Manager general@macp.com.my. However, please be advised that in certain limited circumstances, your rights may be restricted pursuant to the Personal Data Protection Act (PDPA) 2010 and the Credit Reporting Agencies Act 2010.
07. Accuracy of your Personal Information
MACP aims to keep all personal information as accurate, complete, not misleading, up-to-date and reliable as possible. Therefore, the accuracy of your personal information depends to a large extent on the information you provide. As such, it is a condition of us providing our services to you that you;
- Warrant and declare that all your personal information submitted or to be submitted to us are accurate, not misleading, updated and complete in all respects for purposes of acquiring our services and you have not withheld any personal information which may be material in any respect; and
- Promptly update us as and when such personal information provided earlier to us becomes inaccurate, incomplete, misleading, outdated or changes in any way whatsoever by contacting us at the contact details mentioned in item 8 below.
08. Your Rights
You have a right to access the personal data held by MACP about you subject to payment of any administrative/application fees. To obtain a copy of the personal information we hold about you, please email general@macp.com.my, call 603-62078638 or write to us at Music Authors’ Copyright Protection (MACP) Berhad, Unit 8, Level U2, Block D4, (D4-2-8), Solaris Dutamas, No. 1 Jalan Dutamas 1, 50480 Kuala Lumpur. MACP will process your request within a reasonable time and, in the event the request cannot be granted in full, MACP will inform you of the information it keeps about you in general.
09. Changes to our Policy
MACP reserves the right to modify, update and/or amend this Notice from time to time. In the event of such revision being effected, MACP will post a revised Policy in MACP’s website. You may determine if any such revision has taken place by referring to the date on which this Notice was last updated. Your continued use of our services, our website or any related applications or continued dealings with us constitutes your acknowledgement and acceptance of such changes.
